1. Scope

These Terms and Conditions (“Terms”) govern the contractual relationship between:

and all customers, clients, and users of services and products offered through www.rubixtrition.com.
By booking a consultation, purchasing a service, subscribing to a program, or purchasing digital content, the customer agrees to these Terms.

2. Services

Rubixtrition provides nutrition-related education, coaching, guidance, and consulting services, including but not limited to:

  • Individual nutrition consultations

  • Group nutrition consultations

  • Nutrition coaching programs

  • Subscription-based services

  • Workshops and educational sessions

  • Digital downloads

  • E-books

  • Courses

  • Educational resources

  • Future online products and services

The exact scope of services is described on the respective booking, sales, or product pages.

 

3. Nature of Services

Rubixtrition provides educational and coaching services only.
Services offered by Rubixtrition:

  • Are not medical treatment

  • Are not medical diagnosis

  • Are not psychotherapy

  • Do not replace professional medical care

  • Do not establish a doctor-patient relationship

Clients are responsible for consulting qualified healthcare professionals regarding medical conditions, diagnoses, treatments, medications, or health concerns.

 

4. Client Responsibilities

The client agrees to:

  • Provide accurate information

  • Disclose relevant health information where appropriate

  • Inform Rubixtrition of significant changes affecting consultation outcomes

  • Participate honestly in consultations

  • Follow recommendations at their own discretion and responsibility

The client acknowledges that outcomes depend on numerous factors including adherence, lifestyle, medical history, and individual circumstances.

 

5. Booking and Contract Formation

A contract is formed when:

  • A booking is confirmed;

  • Payment is completed; or

  • Rubixtrition confirms acceptance of the client’s request.

Rubixtrition reserves the right to decline bookings where appropriate.

 

6. Pricing

All prices displayed on the website are in Euro (EUR).
As a Kleinunternehmer under § 19 UStG:
No VAT is charged or separately stated.
Prices may be updated at any time without affecting already confirmed bookings.

 

7. Payment Terms

Payments may be processed through:

  • Stripe

  • PayPal

  • Wix Payments

Payment is generally due in advance unless otherwise agreed in writing.
Rubixtrition reserves the right to suspend services until payment has been received.

 

8. Consultation Delivery

Consultations may be conducted via:

  • Zoom

  • Google Meet

  • Microsoft Teams

  • WhatsApp Video

  • In-person meetings

The communication method may be adjusted by mutual agreement.
Clients are responsible for ensuring:

  • Internet access

  • Device compatibility

  • Stable connection

  • Accurate contact details

Rubixtrition is not responsible for technical issues outside its reasonable control.

 

9. Cancellation and Rescheduling Policy

Client Cancellations

  • More than 48 hours before appointment: Full refund available upon request.

  • Less than 48 hours before appointment: No refund.

 

Rescheduling
Clients may reschedule one appointment without charge if notice is provided before the scheduled session.
Additional rescheduling requests may be accepted at Rubixtrition’s discretion.
 

No-Shows
Failure to attend a scheduled appointment without notice will be treated as a completed session and no refund will be provided.

 

10. Cancellation by Rubixtrition

Rubixtrition reserves the right to reschedule or cancel appointments due to:

  • Illness

  • Emergencies

  • Technical issues

  • Circumstances beyond reasonable control

Where appropriate, clients will receive:

  • A replacement appointment; or

  • A refund.

11. Subscription Services

If subscription-based services are offered:

  • Subscription terms will be disclosed before purchase.

  • Billing frequency will be clearly stated.

  • Subscriptions continue until cancelled.

Unless otherwise specified:

  • Cancellation becomes effective at the end of the current billing period.

  • No partial refunds are provided for unused subscription periods.

 

12. Digital Products

Digital products may include:

  • E-books

  • PDF guides

  • Courses

  • Downloads

  • Educational resources

  • Other digital content

Delivery is typically made electronically through:

  • Download links

  • Email delivery

  • Website access

Customers are responsible for providing a valid email address.

 

13. Digital Content Withdrawal Waiver

For digital products delivered immediately after purchase, the customer expressly agrees that:

  • Delivery may begin immediately after purchase.

  • The right of withdrawal may expire once delivery begins.

  • The customer acknowledges and consents to this loss of withdrawal rights.

By purchasing digital content and requesting immediate access, the customer expressly waives the statutory 14-day withdrawal right to the extent permitted by applicable law.

 

14. Refund Policy for Digital Products

Due to the nature of digital products:

  • No refunds are provided after delivery or access.

  • No refunds are provided for downloaded materials.

  • No refunds are provided for accessed digital courses.

Exceptions apply only where required by law.

 

15. Intellectual Property

All content provided by Rubixtrition remains the intellectual property of Rubixtrition unless otherwise stated.
This includes:

  • Programs

  • Written materials

  • PDFs

  • E-books

  • Courses

  • Frameworks

  • Worksheets

  • Graphics

  • Website content

Clients may use purchased materials solely for personal use.
The following are prohibited without prior written permission:

  • Redistribution

  • Resale

  • Commercial use

  • Reproduction

  • Public sharing

  • Modification for commercial purposes

 

16. Confidentiality

Rubixtrition respects client confidentiality and handles information in accordance with the Privacy Policy.
Clients likewise agree not to disclose confidential materials, proprietary methods, or private business information obtained through services.

 

17. Health Disclaimer

Rubixtrition provides nutrition education and coaching.
No guarantees are made regarding:

  • Weight loss

  • Medical outcomes

  • Health improvements

  • Performance results

  • Specific personal outcomes

Information provided is educational and informational in nature.
Clients should seek medical advice from qualified healthcare professionals regarding any medical concerns.

 

18. Limitation of Liability

To the maximum extent permitted by law:
Rubixtrition shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Loss of profits

  • Business interruption

  • Personal decisions made based on provided information

Nothing in these Terms excludes liability for:

  • Intentional misconduct

  • Gross negligence

  • Fraud

  • Liability that cannot legally be excluded under German law

19. Force Majeure

Rubixtrition shall not be liable for delays or failures resulting from circumstances beyond reasonable control, including:

  • Natural disasters

  • Government actions

  • Internet outages

  • Power failures

  • Illness

  • Technical disruptions

 

20. Data Protection

Personal data is processed in accordance with the Rubixtrition Privacy Policy.
Clients are encouraged to review the Privacy Policy before using services.

 

21. Right of Withdrawal for Consumers

Consumers located within the European Union may have statutory withdrawal rights under applicable consumer protection laws.
Where digital content is supplied immediately and the customer has expressly consented to immediate delivery and waiver of withdrawal rights, such rights may expire in accordance with applicable law.

 

22. Amendments

Rubixtrition may amend these Terms where necessary due to:

  • Legal changes

  • Operational requirements

  • Service modifications

Updated versions will be published on the website.

 

23. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.
Mandatory consumer protection rights under the laws of the consumer’s country of residence remain unaffected where applicable.

 

24. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
